Simbird
Terms of Use
The terms for buying and using Simbird eSIM data plans: what you buy, how payment and delivery work, plan validity, refunds and the rules that apply to both of us.
Last updated: October 27, 2026
Who we are and what these terms cover
These terms are an agreement between you and ODBS LLC (“ODBS”, “we”, “us”), a company organised in Wyoming, United States, which operates Simbird. They apply to the Simbird app, the eSIM data plans you buy through it and this website. By creating an account or buying a plan you accept these terms. Our Refund Policy and Privacy Policy, published on this website, are part of them.
The Simbird app is distributed through Apple’s App Store and is also licensed to you under Apple’s standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). Apple is not responsible for the eSIM plans or for support.
The service
Simbird sells prepaid, data-only eSIM plans for travel. An eSIM is a digital SIM that you install on your phone. A plan gives you a set amount of mobile data, or a daily allowance, at a destination for a set period.
- Data only: a plan has no phone number and includes no calls or SMS over the mobile network.
- One-time purchases: each plan or top-up is paid once. There are no subscriptions and no automatic renewals.
- No emergency calls: Simbird does not provide a phone service, so do not rely on it to contact emergency services.
- Not a mobile network: eSIMs are issued by our eSIM suppliers and use the networks of mobile operators at your destination.
Eligibility and your account
You must be at least 18 years old and able to enter into a binding contract. You can look around the app without an account; to buy, you sign in with Apple, with Google or with a code sent to your email address. Give accurate information, including your billing country, and keep access to your account and your email secure: you are responsible for purchases made through your account.
Simbird is not offered in every country; for example, it is not available in India. We may decline to sell a plan where the law or our suppliers do not allow it.
Your phone
To use a plan you need a phone that supports eSIM and is carrier-unlocked; a phone locked to a carrier may only accept that carrier’s SIMs. The Simbird app needs an iPhone with iOS 17.4 or later. Please check your phone before you buy. If an eSIM could not be installed because the phone is not compatible, the Refund Policy applies.
Prices, taxes and payment
Prices are shown in US dollars (USD) and include taxes where they apply. The full price is shown before you pay. If your card is in another currency, your bank converts the amount and may charge its own fees.
You pay by card or Apple Pay. Payments are processed by our payment provider; we do not receive your full card number.
At checkout we only authorize the amount: your bank holds it on your card. We charge (capture) it when your eSIM is ready to be delivered. If the eSIM cannot be delivered, we cancel the order and the hold is released; how quickly it disappears from your statement depends on your bank.
To prevent fraud we may ask for additional card authentication, hold an order for review by a person or decline it. We do not charge for an order we decline.
Delivery and installation
Your eSIM is delivered in the app as soon as it is ready. On iPhone you can install it in one tap; a QR code and manual installation codes are available as a backup. We also email you a receipt with the install details.
Treat the QR code and the installation codes like a key: anyone who has them may be able to install your eSIM. An eSIM can usually be installed only once, on one phone. If you delete it from your phone, it may not be possible to install it again; write to us before you remove it or change phones, and we will help where the supplier allows it.
The plan page shows the period within which the eSIM must be installed. An eSIM that is not used within that period expires.
Plan validity and data
- Validity: each plan is valid for the number of days shown. For most plans validity starts when the eSIM first connects to a network at your destination; for some it starts when you install it. The plan page says which.
- Data plans include a fixed amount of data. The plan ends when the data is used up or the validity ends, whichever comes first.
- Day passes include a daily amount of high-speed data. After it is used, the speed is reduced until the next day starts. Every day pass states its daily allowance and the reduced speed before you buy.
- Unused data and days expire at the end of the validity period. They cannot be carried over, exchanged or paid out, except as the Refund Policy says.
- Top-ups add data to the same eSIM where the plan offers them. The top-up shows the data and the validity you get before you buy it.
- The usage shown in the app comes from the network supplier and can be a few hours old.
Hotspot use is possible where the plan allows it. “5G” means 5G where the local network offers it to your plan; otherwise the eSIM uses 4G/LTE or another available technology.
Networks, coverage and fair use
Coverage, speed and availability depend on the local mobile networks and on your phone, your location and network conditions, which we do not control. We do not guarantee a particular speed or uninterrupted service. Networks may manage traffic, for example during congestion.
Plans are for your personal use while you travel. The networks or we may slow down, suspend or end the use of an eSIM that is used against these terms or far beyond normal personal use, for example for continuous bulk data transfers, in modems or machine-to-machine devices, or to resell connectivity.
Refunds and the right of withdrawal
Our Refund Policy explains when you get a full or a partial refund and how to ask for one. In short: you get a full refund if the eSIM was never installed, or was installed but never connected, when you ask within 30 days of delivery; other cases are reviewed by a person. Refunds go back to the original payment method.
If you are a consumer in the European Union or the United Kingdom, you have a 14-day right of withdrawal. Because a plan is a service that starts right away, at checkout you expressly ask us to deliver the eSIM at once and acknowledge that your right of withdrawal ends once the plan has been fully used. If you withdraw within the 14 days, we refund the part of the plan you have not used. You can withdraw in the app (Account › Receipts › Request a refund) or by email.
Nothing in these terms limits refunds or other rights that the consumer law of your country gives you.
Rules of use
You agree not to:
- use Simbird or an eSIM for anything unlawful, including fraud, spam or harming networks or other people;
- pay with a card or an account you are not authorized to use, or make false chargeback claims;
- resell, rent out or commercially share plans or installation codes without our written permission;
- interfere with or try to get around the security, the limits or the fraud checks of the app, our servers or the networks;
- copy, reverse-engineer or misuse the app, except where the law allows it.
Suspension and ending the agreement
We may suspend or close an account, refuse orders or deactivate an eSIM if we reasonably believe it is used for fraud or against these terms, or if the law or a network requires it. Where we can, we tell you first and explain why.
You can stop using Simbird and delete your account in the app at any time. Deleting your account does not remove an installed eSIM: it keeps working until it expires, but you will no longer see it in the app.
Changes to the service and these terms
We may change the app, the plans on offer and these terms, for example when the law, our suppliers or the service change. A plan you have already bought keeps the conditions shown when you bought it. The date above shows the latest version, and we tell you in the app or by email about changes that matter to you before they apply.
Our responsibility
We provide Simbird with reasonable care and skill. To the extent the law allows, we are not responsible for losses caused by the local networks, by your phone or its settings, or by events outside our reasonable control, and we are not liable for indirect or consequential losses such as lost profits or missed bookings. Our total liability for a plan is limited to the amount you paid for it.
Nothing in these terms excludes or limits liability that the law does not allow to be excluded or limited, such as liability for death or personal injury caused by negligence or for fraud, or your statutory rights as a consumer.
Governing law and disputes
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law principles, and any dispute will be brought before the competent courts of Sheridan County, Wyoming, unless mandatory consumer protection law in your country gives you the protection of its law or the right to bring a claim in its courts. Please contact us first: most problems can be solved quickly by email.
